When purchasing the products offered via the website www.wouf.com, owned by WOOUF, SL, under the WOUF brand, you accept the terms and conditions of these General Contract Conditions, so that before accepting them, please read its content carefully.

If you do not accept the General Contract Conditions, you will not be able to purchase the products and consequently WOUF via its Website will not assume any type of obligation or liability.

Likewise, the User declares being of legal age to buy using our Website, in accordance with the applicable regulations according to the User’s residence.

WOUF reserves the right to modify the content and/or scope of the General Purchase Conditions at any time, without the need to communicate it or notify this in advance, so, before contracting each product, please, read its content carefully since it is the User’s liability to review the General Purchase Conditions before buying any product from the Website.

The General Contract Conditions regulate the distance selling relationship between WOUF and the User, in accordance with the legal stipulations in force in distance selling, the General Law for the Protection of Consumers and Users, Data Protection, and the Services of the Information Society and Electronic Commerce.

WOUF offers its Users two methods to place an order:

  • Using our electronic store www.wouf.com, the User may purchase our products by following the purchase process. Once the order has been placed, the User will receive an acknowledgment of receipt by email or any other electronic communication means equivalent to the address provided.

  • By email: you can send us an email at customercare@wouf.com stating the product reference, the amount you wish to buy, the shipping and billing address. We will confirm your order by email, detailing the product and shipping costs. To validate your order, we will ask you to make the payment by bank transfer, credit card or PayPal.

WOUF reserves the right to cancel any order if it perceives any anomaly in the placement of the order or if the information provided by the buyer was not completed correctly. If this is the case, the User will be notified by email.

Likewise, WOUF informs you that the contract may be drafted in the following languages: Spanish and English

3. Data Protection

WOOUF, SL, in accordance with Regulation (EU) 2016/679, of 27th April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, as well as with Organic Law 3/2018, of 5th December on the Protection of Personal Data and Guarantee of Digital Rights, as Responsible for the Processing of the personal data provided, provides you with the following information:

Data controller:

Purpose of the processing: We process the data and information provided by the individuals concerned in order to be able to manage the order, as well as invoice the products requested.

The communication of the requested personal data is a necessary requirement to be able to manage the order. Likewise, WOUF informs you that it complies with all the requirements laid down by the data protection regulations and with all the technical and organisational measures necessary to guarantee the security of personal data.

Legitimation: The data processing is legitimised to perform the contractual and/or business obligations.

Data retention criteria: The data will only be kept for the time necessary for which they have been collected, unless there is a legal obligation.

Data communication: Data will not be communicated to third parties, except legal obligation or with the express consent of the interested party.

International data transfers: ActiveCampaign, LLC, a company located in the US, is used by WOOUF, S.L to send commercial communications, and this involves an international transfer of data. However, it is adhered to the Privacy Shield, an agreement subscribed by the European Commission approving the legal framework for personal data security between Europe and the US.

Communications by electronic means: As set forth in the current regulations of the Law on Information Society and Electronic Commerce, we request your consent by clicking the acceptance box enabled to this end, to send information about our services and/or products, via email or equivalent electronic communication means.

The interested party is informed that they may revoke their consent to the sending of commercial communications by sending an email to customercare@wouf.com.

4. Product availability

WOUF products availability may vary depending on the Users demand. Despite the fact that WOUF updates its stock periodically, the product requested by the User could be out of stock at that time. In case of non-execution due to unavailability, the User will receive an informative email and the amounts paid for the cancelled order will be credited in a maximum of 30 days.

5. Price

The price for each product will be the one in euros together with each product on the Website and will include the applicable VAT that, where appropriate, may correspond.

Since countries outside the European Union are not subject to Spanish VAT, this tax will be deducted from the purchase price during the checkout process.

Please note that we do not bear the customs fees nor any other fees. You can check the website of your local customs authority in your country for the latest fee update.

WOUF reserves the right to modify its prices at any time and without prior notice. The price applicable to the purchase request made by the User will be the one recorded at the time of accepting the General Purchase Conditions.

6. Payment method

The User can pay their order amount using any of the following methods. During the purchase process they must state their choice:

VISA or MASTERCARD credit card

All transactions involving the transfer of personal or banking data are done using a secure environment, a server based on the SSL (Secure Socked Layer) standard security technology, from Banco Sabadell. All the information that you send us is sent encrypted through the network.

Likewise, the information regarding your credit card is directly entered on the bank’s page, at the POS (Bank’s Point of Sale Terminal) and is not entered or registered in any WOUF server.

When paying with a VISA or MASTERCARD you will always be asked for the following information: card number, expiration date, and a Validation Code that matches the last 3 digits of the number printed in italics on the back of your VISA or MASTERCARD, thus, providing more guarantees on the transaction’s security.

When the amount of a purchase has been fraudulently or improperly charged using the number of a payment card, its holder may demand the immediate cancellation of the charge. In this case, the corresponding debit and reimbursement entries in the supplier and holder accounts will be made at the earliest. However, if the purchase had actually been made by the cardholder and the return demand was not due to having exercised the withdrawal or resolution right and, therefore, had improperly demanded the cancellation of the corresponding charge, he will remain obliged to compensate WOUF for damages caused as a result of such cancellation.

PayPal offers a service specially designed for those who do not wish to use the traditional payment methods.

Bank Transfer: Only if placing an order by email

When choosing the bank transfer you will receive, together with your order confirmation, an email with WOUF bank details.

When making the transfer it is very important that you write the order number, name and surname in the subject line, and make the transfer within 3 days after the order confirmation date in order to validate it.

If you want, you can send us the confirmation of the transfer by e-mail customercare@wouf.com But, in any case, the order will not be considered effective until our administration department received the bank confirmation of the transfer. Please note that the payment has to be made in EUROS and that all eventual exchange and banking commissions should be borne by you.

As for bank transfers made from outside Spain, when ordering the transfer, it is very important that you always inform your bank to pay the commissions at origin, those bank commissions and expenses corresponding to your entity. Otherwise, WOUF could stop your order’s shipment as it has not received the full payment.

Possible exchange and banking commissions are borne by the User.

7. Shipping charges

Shipping charges are not included in the price, they will be calculated automatically based on your order and location. Likewise, the shipping amount will be shown at the end of the purchase process.

All shipments to Spain, Ceuta, Melilla, the Canary Islands and the Balearic Islands are made with TNT.

All shipments to Europe and outside the European Union are made with Fedex Company

8. Execution and delivery times

WOUF will ship products in Spain, Ceuta, Melilla, the Canary Islands, the Balearic Islands, Europe, as well as outside the European Union.

Once the User has paid for the product, WOUF has confirmed it, and the confirmation email for their purchase has been sent to the User, the products will be sent to the address stated by the User, complying the following deadlines:

Spain: 24h – 48h (business days)

Balearic Islands: 48h – 72h (business days)

Ceuta, Melilla and the Canary Islands*: 48h – 72h (business days).

*Please note that local duties and taxes must be borne by the buyer. You can check your local customs authority website in your country for the latest fee update.

Europe: Delivery time for a shipment within the European Union is 2 to 5 business days.

International: Delivery time for a shipment outside the European Union is 3 to 5 business days with Fedex Company, excluding customs processing.

WOUF shall not be liable for any errors that may occur in the delivery of the products purchased in the event that the User has not correctly completed the form on the Website. If there were any incidents in the delivery time, WOUF will inform the User adequately and immediately. The User must take into account that, Orders placed during the weekend will be processed the following Monday and all orders placed during holidays will be processed the next business day.

In case of not being able to deliver the product due to the absence of the recipient, the transport agency will leave a notice and will try to contact the recipient by phone. After two unsuccessful attempts, the User must contact the transport agency to proceed with the delivery.

The risks of the products will be borne by the User from the moment they are delivered and, in the case of their return, they will continue to be borne by the User until they are delivered to WOUF.

Once our warehouse has shipped your order, you will receive an email confirming your package has been shipped. This email will include your Fedex Company or TNT tracking number, which you can use to track your package until it arrives.

To do this, you just need to go to the Fedex Company or TNT website and enter your tracking number in the appropriate box to track your package.

9. Withdrawal

The User will have the right to withdraw from the contract, without any type of penalty, within a period of fourteen (14) calendar days from the date the product is received.

Any change or refund will only be accepted if the item is in perfect condition with the labels and the corresponding packaging (boxes, bags, etc.) in the same way in which they were received.

To exercise the withdrawal right, the user will only have to follow these steps:

  1. Send an e-mail to customercare@wouf.com indicating the order reference in order to obtain the Return Merchandise Authorization (RMA) number. Returns will not be accepted without an RMA number.
  2. On the packing list of the initial shipment, write down the number (count) of products of products to be returned in the “return quantity” column, along with the reason for return in the “return code” column.
  3. Include the packing list with all the information needed in the return package.
  4. Attach the provided return label to the parcel, ensuring the original shipping label is not visible.

We recommend to obtain proof of deposit and tracking number of the postage in order to properly execute the return.

Once the User has exercised their Withdrawal right, WOUF will return all payments received to the User, within a period of fourteen (14) calendar days from the date on which the User informs WOUF of their decision to withdraw from this contract , although the refund may be delayed if the products or proof of return have not been received within this period.  WOUF will make the refund using the same payment method used by the User for the initial transaction.

The User will bear the cost of returning the purchased product.

Any change for another item will imply new shipping charges that will be borne by the user.

11. Complaints and claims

The User may direct their complaints and claims to customercare@wouf.com

WOUF must respond to the claims received in the shortest possible time and in any case within a maximum period of one month since the claim was submitted.

In accordance with EU Regulation No. 524/2013, the European Commission has an online dispute resolution platform available to Consumers and Users, which is available at the following link: http://ec.europa.eu/consumers/odr/. Consumers can submit their claims using the online dispute resolution platform.

12. Applicable law and jurisdiction

These General Contracting Conditions shall be governed and interpreted in accordance with Spanish legislation.

Disputes that may arise between WOUF and the User must be settled in the Spanish Courts.
